Terms and Conditions

These Terms and Conditions (“Terms”) govern your use of faitschbrotherstucson.com (the “Website”) and any dumpster rental or related service you request from Faitsch Brothers Dumpster Rentals of Tucson (“Faitsch Brothers,” “we,” “us,” or “our”). By using the Website, requesting a quote, or booking or accepting delivery of a dumpster, you (“Customer,” “you”) agree to these Terms. If you do not agree, please do not use the Website or our services.

1. Our Services

We provide roll-off dumpster rental, delivery, and pickup for residential and commercial customers in Tucson, Arizona and nearby areas. Our dumpsters are intended for home cleanouts, remodeling, roofing, landscaping, demolition, construction debris, and similar projects. We offer three sizes:

Dimensions are approximate and may vary slightly between units. Information on the Website, including descriptions of what each size can hold, is a general guide and not a guarantee that your debris will fit.

2. Quotes and Booking

You can request a quote through the Website’s contact form or by calling (520) 419-1092. A booking is confirmed only when we confirm the dumpster size, delivery address, delivery date, and price with you. Same-day and next-day delivery may be available but are not guaranteed, and depend on our schedule and inventory. You agree that the information you give us, including your name, contact details, delivery address, and type of debris, is accurate and complete.

3. Pricing and Payment

• Flat rates. Our standard flat rate covers delivery, pickup, the included rental period, the included weight, and disposal of acceptable materials. The price that applies to you is the price we quote and confirm when you book. Prices shown on the Website may change without notice.
• Service-area pricing. Flat rates shown on the Website do not apply to Avra Valley, Oro Valley, Marana, and Vail. Please call us for pricing in those areas.
• Payment due on delivery. Payment in full is due when the dumpster is delivered, unless we agree otherwise in writing. We may decline to leave the dumpster if payment is not made.
• Additional charges. You agree to pay additional charges that apply under these Terms, such as weight above the included tonnage, rental days beyond the included period, a trip fee or return charge if the dumpster cannot be placed or picked up because of blocked access or an unready site, extra fees for prohibited materials or contamination, and damage costs. We will tell you the rates for these charges when you book or when they arise.
• Taxes and fees. Quoted prices include or exclude applicable taxes and fees as stated when you book. Any government fees, disposal-facility surcharges, or permit costs you are responsible for are your own.
• Late or failed payment. If you do not pay an amount when due, we may charge reasonable collection costs and interest as allowed by law, and may refuse future service.

4. Rental Period and Extensions

Every standard rental includes 10 days of use at no extra charge, counted from the delivery date. If you need more time, call us before the period ends so we can arrange an extension. We will confirm the extra rental rate when you ask. If you keep the dumpster beyond the agreed period without arranging an extension, you agree to pay the additional rental charges until it is picked up.

5. Delivery, Placement, and Pickup

• Site access. You must make sure the delivery location is clear and accessible, with enough room for our truck and the dumpster, including overhead clearance (for example, tree limbs, wires, and gates) and a path wide and firm enough for a loaded truck.
• Placement. We will go over placement with you before delivery. Our drivers may decide not to place the dumpster, or to place it elsewhere, if they believe the location is unsafe or could cause damage. We place dumpsters on driveways and other private property at your direction, and you accept the risk that a heavy truck and loaded dumpster can mark, crack, or damage pavement, concrete, pavers, landscaping, sprinklers, septic systems, and underground lines.
• Protecting surfaces. You are responsible for protecting your surfaces, for example with plywood under the dumpster wheels or rails. We are not responsible for ordinary wear or marks from properly placed equipment.
• Permits and approvals. You are responsible for any permit, homeowners’ association approval, landlord consent, or other authorization needed to place a dumpster on your property or on a public street, sidewalk, or right-of-way. We are not responsible for fines or removal caused by a missing permit.
• Pickup. Please call us when you are finished, or before the rental period ends, to schedule pickup. The dumpster must be accessible, not blocked by vehicles or materials, and loaded as described below. If we cannot pick it up, additional charges may apply.

6. Acceptable and Prohibited Materials

Acceptable materials include construction debris, household junk, renovation waste, roofing materials, yard debris, and non-hazardous commercial waste.

Prohibited materials. You may not place hazardous or restricted items in the dumpster. This includes, for example:

• Hazardous waste, chemicals, solvents, paint, oil, fuel, pesticides, and asbestos
• Batteries, tires, appliances containing refrigerants, and electronics that must be recycled separately
• Medical or biological waste, and any flammable, explosive, or radioactive material
• Liquids and any material that is illegal to dispose of in a landfill

Some items are restricted or require special handling. If you are unsure whether something is allowed, please ask us before loading it. If prohibited materials are found, we may refuse pickup, charge extra fees for sorting, removal, and special disposal, and hold you responsible for any fines, cleanup costs, or damages that result.

7. Loading, Weight, and Safety

• Fill line. Do not load debris above the top edge of the dumpster. Overloaded dumpsters cannot be moved safely, and we may refuse pickup until the load is reduced.
• Weight limit. Each size includes a set tonnage (see Section 1). Weight above the included amount is charged at the rate we quote you, based on the scale ticket from the disposal facility. Very dense material, such as concrete, brick, soil, or roofing shingles, can reach the weight limit well before the dumpster is full, so please ask us before loading heavy material.
• Safe use. You are responsible for loading the dumpster safely and keeping children, pets, and others away from it. Do not climb into a loaded dumpster, burn anything in it, or let it block traffic, walkways, fire hydrants, or driveways of others. Keep the area around it clear.
• Lighting and visibility. If the dumpster is on a street or near traffic, you are responsible for any required lighting, cones, or warnings.

8. Ownership and Care of Equipment

The dumpster remains our property at all times. You may not sell, lend, sublet, move, or alter it. You are responsible for it from delivery until pickup, including loss, theft, vandalism, fire, and damage beyond normal wear, and will pay the repair or replacement cost.

9. Cancellations and Rescheduling

Please call us as early as you can if you need to cancel or reschedule. If you cancel on short notice after the dumpster has been dispatched, or if we cannot deliver because the site is not ready, we may charge a reasonable cancellation or trip fee. Weather, road conditions, equipment issues, and similar causes beyond our control may delay deliveries and pickups, and we will reschedule as soon as reasonably possible.

10. Customer Reviews and Website Content

The customer reviews on the Website are posted by third parties on Google and displayed through a review plugin. They reflect the opinions of those customers, not of Faitsch Brothers, and we do not guarantee that your experience will be the same.

The Website’s text, logos, photos, graphics, and design belong to Faitsch Brothers or its licensors and are protected by copyright and trademark law. You may view and print pages for your personal or business use in connection with our services, but may not copy, reproduce, or use them for any other purpose without our written permission.

11. Acceptable Use of the Website

You agree not to misuse the Website, including by attempting to gain unauthorized access, introducing malware, scraping it in a way that harms its operation, submitting false or misleading requests, or using it for any unlawful purpose. We may block access to anyone who does.

12. Disclaimers

The Website and our services are provided on an “as is” and “as available” basis. We work to keep the information on the Website accurate and current, but we do not guarantee that pricing, availability, service areas, descriptions, or other content are complete, error-free, or up to date. To the fullest extent permitted by law, we disclaim all warranties not expressly stated in these Terms, including implied warranties of merchantability and fitness for a particular purpose.

13. Limitation of Liability

To the fullest extent permitted by law, Faitsch Brothers and its owners, employees, drivers, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, project delays, or lost business, arising from the Website or our services. Our total liability for any claim relating to a rental is limited to the amount you paid us for that rental. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for our own gross negligence or willful misconduct.

14. Indemnification

You agree to defend, indemnify, and hold harmless Faitsch Brothers and its owners, employees, and agents from claims, fines, penalties, damages, and costs (including reasonable attorneys’ fees) arising from your use of the dumpster, materials you place in it, your failure to get required permits, damage to property at the delivery site, or your breach of these Terms.

15. Insurance and Licensing

We are a licensed and insured business. Our insurance does not cover your property or damage to surfaces and underground items at the delivery site, and does not replace any insurance you should carry for your own project.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try in good faith to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Pima County, Arizona, and you consent to those courts’ jurisdiction.

17. Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a new effective date. Your continued use of the Website or our services after the update means you accept the revised Terms. The Terms in effect when you book a rental apply to that rental.

18. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any right is not a waiver of it. These Terms, together with any written quote or booking confirmation and our Privacy Policy, are the entire agreement between you and Faitsch Brothers about the Website and your rental.
